West Virginia has no state law limiting when a private employer can ask about your record.
Private employers There is no statewide ban the box for private or public hiring and no West Virginia city ordinance that reaches private employers. The state expungement law was broadened in 2019 to cover many nonviolent misdemeanors and some felonies, and that is the lever that changes what an employer sees. Once a record is expunged, West Virginia law lets you answer no: you may state that the expunged matter never occurred. No state fair chance hiring law. Expungement: W. Va.
