What the law gives you in Washington
A Washington employer with fifteen or more workers cannot ask about your record until they have offered you the job, and they must hold that job open at least two business days while you respond.
Private employers Covered Washington rewrote this law in 2025 and the new rules took effect for employers with fifteen or more employees on July 1, 2026 and reach smaller employers on January 1, 2027. Until then a small employer only has to wait until they have decided you are otherwise qualified, which is the older and weaker standard most published guides still describe. Job ads cannot say no felons, blanket bans on people with records are illegal, arrests and juvenile convictions cannot be used at all, and time elapsed is measured excluding any period you were incarcerated.
