Virginia banned the box for state government jobs only, so a private employer here can still ask on the application.
Private employers Government jobs only State agency applications drop the question under a state personnel policy, and no Virginia statute does the same for private employers. Virginia cities cannot fill the gap because they hold only the powers the state hands them, and it has not handed them this one. Virginia’s record sealing regime went live on July 1, 2026: a private employer may not require you to disclose a sealed or expunged matter, you may deny it happened, and a willful violation is a misdemeanor for each violation. The state police are not due to send the first automatic sealings until October 1, 2026, so petitioning is the live route right now. Va.
