What the law gives you in Texas
Texas has no state law limiting when a private employer can ask about your record, and the Austin ordinance that used to protect you is no longer enforced.
Private employers House Bill 2466 would have made Texas the next state to reach private employers. It died in a House subcommittee in March 2025 and never became law, so any guide saying Texas passed a fair chance law in 2025 is wrong. Austin still lists a Fair Chance Hiring Ordinance on its website, but the Texas Regulatory Consistency Act of 2023 overrides local labor rules and that ordinance has not been enforceable against private employers since.
