South Dakota has no state law limiting when a private employer can ask about your record.
Private employers There is no statewide ban the box for private or public hiring and no South Dakota city ordinance reaching private employers. The question can sit on the application and the employer can decide however they want. Once a record is sealed, though, South Dakota law does let you answer no: you may state that the arrest, charge or conviction never occurred. No state fair chance hiring law.
