South Carolina has no state law limiting when a private employer can ask about your record.
Private employers There is no statewide ban the box for private or public hiring and no South Carolina city ordinance that reaches private employers. Expungement is the route that changes what an employer sees, but South Carolina does not give you a statute saying you may answer no. What it gives you instead is a rule that an expunged charge may not be used against you, which is weaker in practice because it puts the burden on you after the fact. No state fair chance hiring law.
