What the law gives you in New York

New York sets no rule about when an employer can ask, but a private employer with ten or more workers cannot turn you down over a conviction unless it is directly related to the job or would create an unreasonable risk.

Private employers Covered The employer has to work through eight factors, including how long ago the offense was, how old you were, and what you have done since, and a certificate of relief from disabilities or good conduct creates a legal presumption that you are rehabilitated. No employer of any size may ask about an arrest that did not end in conviction, a youthful offender case, or a sealed conviction, and New York clean slate sealing has since November 2024 sealed misdemeanors three years and felonies eight years after release. New York City is far stronger: four or more employees, no question until after a conditional offer, a written Fair Chance Notice, and the job held open at least five business days while you respond.
