What the law gives you in New Jersey

A New Jersey employer with fifteen or more workers cannot ask about your record until after the first interview.

Private employers Covered Job ads cannot say that people with records will not be considered, and a record that has been expunged or pardoned cannot be used at all. Two things people expect are not in this law: there is no lookback limit and no requirement to weigh the offense against the job. Both were written into the bill and cut before it passed, so guides quoting a five-year or ten-year New Jersey lookback are citing language that never became law. State law also overrides older city ordinances, so Newark’s rule now covers only city hiring. New Jersey Opportunity to Compete Act, N.J.S.A. 34:6B-11 to 34:6B-19 · checked September 17, 2026
