North Dakota banned the box for government jobs only, so a private employer here can ask about your record on the application.
Private employers Government jobs only State law stops the state, counties, cities and park districts from asking about your record until they have selected you for an interview. Private employers are not covered, and no North Dakota city ordinance reaches them. What North Dakota does control is the record itself: the state bureau may release only convictions, or an arrest or charge from the last three years, and never a record that has been purged or sealed.
