Montana has no state law limiting when a private employer can ask about your record.
Private employers No Montana city can help either, because state law bars self-governing cities from reaching into private employment relationships. Montana is also one of the hardest states to clear a record in: there is no felony expungement, misdemeanor expungement is discretionary, and no Montana statute gives you the right to answer no about a cleared offense. Federal law is your floor, so if a background check company is involved you get a copy of the report and time to dispute it before the rejection is final. No state fair chance hiring law.
