Add a companyWhat the law gives you in Massachusetts
A Massachusetts employer with six or more workers cannot ask about your record on the application, and cannot ask at all about a misdemeanor more than three years behind you.
Private employers Covered Some things can never be asked about: an arrest that did not end in conviction, a sealed or expunged record, a juvenile case, and a first conviction for drunkenness, simple assault, speeding, a minor traffic offense, affray or disturbing the peace. Through the state CORI system a standard employer sees felonies for ten years and misdemeanors for five after the case ends. When they may ask At the interview This is the earliest point in the process a covered employer may raise your record.
How far back Three years for a misdemeanor, counted from your conviction or your release, whichever came later Convictions older than that cannot be held against you by a covered employer.
If they say no You have a step They have to hand you your criminal record before they question you about it, and again before they turn you down because of it.
