A Louisiana employer can ask about your record whenever they want, but they cannot use an arrest that did not end in a conviction and they have to weigh the offense against the actual job.
Private employers Covered This covers every employer in the state, and most ban the box lists get it wrong by filing Louisiana under public sector only. The employer has to consider the nature and gravity of the offense, how long ago it happened, and the nature of the job before deciding a record disqualifies you. There is no timing rule, so the question can still be on the application form. Louisiana’s separate ban the box statute is narrower than it sounds: it covers the state unclassified service only, not parishes or cities, and New Orleans and Baton Rouge cover their own hiring and contractors.
