Private employers Government jobs only The 2015 executive order removed the conviction question from state agency applications and nothing more. Georgia does have one statewide rule that binds private employers, and it is easy to miss: a first offender discharge or a restricted or sealed record may not be used to disqualify you from any job in either the public or the private sector, outside a listed set of sensitive positions. Be careful with it, because Georgia gives you no matching right to answer no. In Atlanta the city went further in 2022 and made criminal history status a protected class, which does bind private employers in the city.
